Divorce in Hidalgo County
Not every marriage lasts as long as planned. Sometimes, divorce seems like the only option available. Divorce is the process by which a husband and wife legally dissolve their marriage. In Hidalgo County, divorces are filed at the County Courthouse in Edinburg. Once the divorce is filed, your case is assigned to a Court. From there the parties begin the process of dividing the community assets and resolving any disputes about child custody. Most of the time when a husband or wife file for divorce, the suit is based on insupportability of the marriage, also known as No Fault divorce. Of course, either spouse may allege other grounds divorce such as adultery, cruelty, abandonment, among other things.
FLAT FEE DIVORCE
A divorce does not always have to be expensive. The amount of legal fees paid is related to the level of agreement between the parties. Attorneys typically bill on an hourly basis. When the parties can agree amongst themselves, the billable hours can be kept much lower.
By agreeing amongst themselves, the parties can keep the cost of the divorce down. Agreements usually occur when the parties are able to decide for themselves about living arrangements of children and the division of marital property.
In contested divorces, where the parties don’t agree, child visitation and division of the marital property are the two areas that result in increased time in court for the lawyers. This in turn equals higher legal fees.
The solution to preventing sky high legal fees is a flat fee divorce. This option is available to divorcing couples when the parties agree to the divorce and reach an agreement about the major issues of the divorce; the children and house.
